This Privacy Notice describes how Benchmark Analytics (“we,” “us,” or “our”) may use and disclose Protected Health Information (PHI) and how you can access this information. Please review it carefully.
DEFINITIONS
Protected Health Information (PHI): Individually identifiable health information transmitted or maintained in any form or medium, which relates to an individual’s past, present, or future physical or mental health condition, healthcare provided, or payment for healthcare.
USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION
Permitted Uses and Disclosures
Benchmark Analytics may use or disclose your PHI for the following purposes:
- For Analytics and Service Improvement: To analyze data patterns, identify trends, and improve our services.
- With Your Authorization: We will obtain your written authorization before using or disclosing your PHI for purposes other than those described in this Notice.
- As Required by Law: We will disclose PHI when required to do so by federal, state, or local law.
- Business Associates: We may disclose PHI to our business associates who perform functions on our behalf
or provide us services if the PHI is necessary for those functions or services.
Minimum Necessary Standard
When using or disclosing PHI, we will make reasonable efforts to limit the PHI to the minimum necessary to accomplish the intended purpose.
YOUR RIGHTS REGARDING YOUR PHI
You have the following rights regarding the PHI we maintain about you:
- Right to Inspect and Copy: You have the right to inspect and obtain a copy of your PHI.
- Right to Amend: If you believe the PHI we have is incorrect or incomplete, you may ask us to amend the information.
- Right to an Accounting of Disclosures: You have the right to request a list of disclosures we have made of your PHI.
- Right to Request Restrictions: You have the right to request a restriction on the PHI we use or disclose about you.
- Right to Request Confidential Communication: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location.
- Right to a Paper Copy of This Notice: You have the right to receive a paper copy of this Notice upon request.
OUR LEGAL DUTIES
We are required by law to:
- Maintain the privacy of your PHI
- Provide you with this Notice of our legal duties and privacy practices
- Follow the terms of the Notice currently in effect
- Notify affected individuals following a breach of unsecured PHI
We reserve the right to change our privacy practices and this Notice, and to make the new provisions effective for all PHI we maintain. If we make a material change to our privacy practices, we will post the revised Notice on our website and provide a copy upon request.
ADMINISTRATIVE ACCESS TO PHI
Certain authorized employees may access PHI for administrative functions, including:
- Quality assurance and improvement activities
- Technical support and system maintenance
- Data analysis and reporting
All employees with access to PHI receive appropriate training and are subject to confidentiality requirements.

All complaints must be submitted in writing. You will not be penalized or retaliated against for filing a complaint
